Mediation is a voluntary and confidential process where a neutral third party, known as the mediator, helps individuals or groups resolve disputes by exploring solutions, identifying issues, clarifying facts, not to mention, negotiating settlement. Unlike a judge, an arbitrator, juror the mediator does not make decisions for the parties but facilitates communication and negotiation to reach a mutually acceptable agreement.
The mediation process typically begins with a pre-mediation discussion, where the parties outline their concerns and goals. During the mediation session, the mediator guides the conversation, ensures all parties are heard, and helps identify solutions or compromises. Mediation can take place in person or virtually, such as via Zoom, depending on the parties’ preferences.
The mediator acts as an impartial facilitator, ensuring a fair and balanced discussion. They help clarify issues, manage emotions, and encourage productive dialogue. Mediators do not provide legal advice or determine outcomes but focus on fostering understanding and collaboration.
The duration of mediation varies based on the complexity of the case. Simple disputes may be resolved in a few hours, while more intricate cases and family matters could take a full day or even multiple sessions. Factors such as the number of parties involved, the level of disagreement, and the willingness to cooperate influence the timeline.
